At the Private Center for Alternative Conflict Resolution Methods, we recognize the importance of fair and equitable remuneration for the time and effort dedicated to conflict resolution and prevention. Therefore, we provide our clients with a detailed fee schedule that governs our alternative dispute resolution processes, ensuring transparency and fairness at every stage.

Our methodology focuses on the efficiency and effectiveness of the process, managing an optimal balance between the volume of unique and standardizable cases. This strategy does not compromise the quality of our services; On the contrary, it allows us to concentrate on less complex cases, guaranteeing a high standard of excellence and personalized attention. We are committed to maintaining a superior level of quality in all our services, while standardizing and optimizing conflict prevention procedures.

We recognize that, although the documentation required for these processes may be less complex, this does not in any way diminish the quality or integrity of the contractual content. Our approach ensures that each case is handled with the utmost professionalism, ensuring effective and satisfactory results for all parties involved.

Tariff Rules for matters with quantifiable value.

 

For the preparation of any contract or agreement that must be formalized by mutual agreement of the parties or in accordance with legal provisions, a fee equivalent to 5% of the total value of the legal transaction will be established, as long as said value does not exceed 2,000 days of the Current General Minimum Wage (S.M.G.V.), currently set at $207.00 MXN. For example, if the value of the contract or agreement is $414,000.00 MXN (calculated as 2,000 days multiplied by $207.00 MXN), the applicable fee will be $20,700.00 MXN, corresponding to 5% of the value of the business.

In cases where the value of the contract or agreement exceeds 2,000 days of S.M.G.V. but does not exceed 10,000 S.M.G.V. days, an additional 2% fee will be applied on the amount that exceeds the initial limit of 2,000 days. For example, for a contract or agreement valued at $1,656,000.00 MXN (equivalent to 8,000 days of S.M.G.V.), the fee for the service provided will be $33,120.00 MXN, which represents 2% of the value that exceeds 2,000 days of S.M.G.V.

For values that exceed 10,000 S.M.G.V. days, a 1% charge will be imposed on the amount that exceeds this threshold, regardless of the total amount of the contract or agreement.

These provisions ensure fair and proportional remuneration for legal services provided, reflecting our commitment to equity in compensation, commensurate with the time and effort dedicated to the management and resolution of contractual matters.

Tariff Rules for matters without quantifiable value.

The value assigned to alternative dispute resolution methods is established based on the total amount of claims submitted. In situations where the Mediation Request does not contemplate claims of a monetary nature, or when the controversy concerns aspects that are not susceptible to monetary valuation, a minimum administrative fee of $15,000 MXN will be imposed, subject to possible adjustments. These adjustments will be determined at the discretion of the Center, after consultation with the parties involved and the service provider, taking into account the relevant circumstances.

It is imperative that the mediator maintains a detailed and reliable record of his or her work and the time spent resolving the conflict. Once the mediation is concluded, a copy of these records will be provided to the parties and the Center, accompanied by the invoice issued by the mediator.

After consultation with the parties and the mediator, the Center will set the final amount to be remunerated to the mediator. This calculation will take into consideration the hourly or daily rates, as well as other relevant elements, such as the complexity of the matter in dispute, the inherent complexity of the mediation process, the total time invested by the mediator, the diligence evidenced by the mediator, and efficiency in the conduct of mediation procedures.
